MIAMI COUNTY — Miami County Common Pleas visiting Judge William Wolff Jr. sentenced Justin Clark, 29, of Piqua, to serve five years on community control for fifth-degree felony drug possession on Monday.
Judge Wolff reserved 12 months in prison if Clark fails to comply with conditions of his community control including drug treatment, curfew, mental health assessment and maintaining employment.
“Dealing with this drug problem is a full-time proposition,” Judge Wolff said. “We really wish you luck.”
According to Clark’s attorney Dustin Davis, Clark has been clean for eight months and was cooperative with authorities during the incident. Clark apologized to the court and said his sobriety has allowed him “to see a clear light now.”
Miami County assistant prosecutor Janna Parker remained silent during sentencing.
Clark overdosed on heroin in the bathroom of the Piqua Tim Horton’s restaurant where he was previously employed on Oct. 29, 2016. Clark was discovered by a co-worker who found him struggling to breathe on the floor with a needle in his hand, according to reports.
The report further states medics took a needle from Clark’s hand and picked up a clear capsule of heroin from the floor next to Clark. Medics revived him with Narcan.
Clark later admitted to officers he was abusing heroin and wanted help for his addiction but didn’t know where to go. Another medic told the officer Clark had overdosed at his home a few weeks earlier. The medics told the officer they had to revive him with Narcan in that incident and Clark was given information for treatment at that time.
The officer found two more capsules on Clark’s person and another one on the bathroom floor of the restroom.
